Human rights or Civil Liberties issues are not considered in their true perspective world over. Traditionally Governments across the world have been investing heavily in knowing more and more about their citizens and residents. This hunger to know everything could have been catastrophic if civil liberties activists were not so active. Nevertheless, we are slowly moving towards a totalitarian and Orwellian world thanks to the super pervasive and intruding technologies.</div>

We anticipated this trend way back in 2009 when we started discussing about <a href="https://hrpic.blogspot.com/" rel="noopener" style="border: 0px; color: #9f9f9f; margin: 0px; outline: none; padding: 0px; vertical-align: baseline;" target="_blank">Human Rights Protection In Cyberspace</a>. Soon we realised that we need a much focused and dedicated initiative in this regard. So we launched world’s exclusive Techno Legal <a href="http://ptlb.in/clpic/" rel="noopener" style="border: 0px; color: #9f9f9f; margin: 0px; outline: none; padding: 0px; vertical-align: baseline;" target="_blank">Centre Of Excellence For Protection Of Human Rights In Cyberspace (CEPHRC)</a>. Since then we have been continuously working to strengthen Civil Liberties and Human Rights in Cyberspace.</div>

In the year 2019, the CEPHRC has been merged with the Techno Legal Projects Of TeleLaw Private Limited (TPL) and PTLB Projects LLP. This has been done to consolidate our Techno Legal LegalTech, EduTec, TechLaw and other similar projects. As both TPL and PTLB Projects LLP are recognised startups by Department for Promotion of Industry and Internal Trade (DPIIT) and MeitY Startup Hub, we are working to further rejuvenate the CEPHRC project soon.</div>

In this post we are discussing the Techno legal issues associated with the use of Artificial Intelligence (AI) in various fields. We are more concerned with the Human Rights and Civil Liberties implications of AI and not the friendly or non friendly aspects of AI. Just for the sake of reference, the roots of concern about AI are very old. In fact, by 1942 these concerns prompted Isaac Asimov to create the “Three Laws of Robotics” – principles hard-wired into all the robots in his fiction, intended to prevent them from turning on their creators, or allowing them to come to harm. Also philosopher Nick Bostrom has said that superintelligent AI systems with goals that are not aligned with human ethics are intrinsically dangerous unless extreme measures are taken to ensure the safety of humanity. He believes that we should assume that a ‘superintelligence’ would be able to achieve whatever goals it has. Therefore, it is extremely important that the goals we endow it with, and its entire motivation system, is ‘human friendly’.This takes us to the concept of friendly artificial intelligence. Eliezer Yudkowsky asserts that friendliness (a desire not to harm humans) should be designed in from the start, but that the designers should recognise both that their own designs may be flawed, and that the robot will learn and evolve over time. Thus the challenge is one of mechanism design—to define a mechanism for evolving AI systems under a system of checks and balances, and to give the systems utility functions that will remain friendly in the face of such changes.</div>

If you are a software designer or coder you design/code the software as per your conceptions and ideals. You may create a software as open source or you may prefer to sell it as a commercial software. You may give a limited features free trial or you may give a full fledged version as a free trial. You may create the software for Linux or you may create it for Windows systems. You may create the software for a particular country or language or you may create a global software with multiple languages. In short, no two software are created with same ideology and objectives. What is more concerning is the fact that we create things keeping in mind our own experience, ideology, political allegiance, etc. We may create a software for law enforcement and intelligence agencies for the sole purpose that it can be used by them for snooping, spying or even violating the Civil Liberties of people.</div>

However, in all these activities “Human Element” is present. Now think what would happen if a spying software is managed by an AI driven system without involvement of human beings at all? We do not wish to be alarmist in this regard but the least we can expect from the AI makers is that Human Rights and Civil Liberties safeguards are hardwired into all AI systems. We have a tendency to pass on our bias and prejudice and have a tendency to violate Human Rights of our fellow humans. Naturally we would pass these negative traits to AI too if proper safeguards are not put at place. Also using AI without adequate Cyber Security, Privacy and Data Protection is a recipe for disaster. Whether we like it or not, atrocities of Orwellian technologies would further increase in future and putting in place sound Human rights Protection in Cyberspace is essential.</div>

Law and technology are never compatible and law is always behind the technology. Even if the lawmakers try to bridge this gap still world over law and technology are not good companions. This problem has escalated at the legal and judicial sides too and till the beginning of February 2020 we are still discussing whether we should use online dispute resolution (ODR), e-courts, etc in our respective jurisdictions. </div>

This is where the role of LegalTech industry becomes crucial. The LegalTech industry can infuse technological innovations into the almost stagnant legal and judicial systems of the world. But we are facing few problems in this regard. The first one is that there is a resistance from the legal fraternity and governments of various nations to use technology for legal and judicial purposes. The second problem is that most of the stakeholders are themselves not aware what LegalTech is and how to use it. For instance, a vast majority of stakeholders believe that LegalTech means forcing artificial intelligence and automation upon selective few aspects. This is the main reason why LegalTech industry is not growing as these tech hypes would be over sooner than we expect. With this we would witness a series of failures and closing of LegalTech projects world over.</div>

We must accept the truth that LegalTech is neither AI/automation nor it means purchase of expensive hardware and software. Many beautiful LegalTech projects have been implemented by use of simple open source tools. In fact, a single tool can be used by different stakeholders differently and one may create a wonderful product or service while the other may create a total mess with the same tool. </div>

One such LegalTech pioneer is <a href="http://perry4law.org/" target="_blank">Perry4Law Organisation (P4LO)</a> that has launched the world's first ever techno legal LegalTech project named <a href="http://telelaw.in/" target="_blank">TeleLaw</a>. The TeleLaw is a techno legal and LegalTech startup recognised by the DPIIT, Govt of India. TeleLaw is a unique LegalTech project that is working to bridge the gap of access to justice and legal aid. But TeleLaw is covering Business to Business (B2B) (like lawyers, law firms, companies etc), Business to Consumer (B2C) (like end users directly), Business to Government (B2G) (like PSUs, govt departments, etc) and many more national and international stakeholders. TeleLaw is also helping national and international organisation working in the fields of international trade, intellectual property rights, international trade, etc.</div>

This is a project that must not be ignored by the Indian government as it has great potential to make India a global hub for techno legal services. This would generate wealth, employment and technological innovations for Indian economy too. Let us hope that Indian government would support the TeleLaw project to become a jewel of India and a global leader in techno legal fields. </div>

Cyber security is a techno legal field that requires patience and techno legal expertise to practice. India has been a
late entrant in the cyber security field and a robust and resilient
<a href="http://perry4law.org/cecsrdi/?p=1145" target="_blank"><span style="text-decoration: none;">cyber security infrastructure in India</span></a> is still missing. We have
a <a href="http://perry4law.org/cecsrdi/?p=1068" target="_blank"><span style="text-decoration: none;">national cyber security policy of India (NCSP) 2013</span></a> but the same
has remained on paper only so far. An <a href="http://perry4law.org/cecsrdi/?p=1128"><span style="text-decoration: none;">analysis</span></a>
of the existing cyber security policy of India would reveal that
India has still to do its homework in the cyber security field. We at
<a href="http://perry4law.org/" target="_blank"><span style="text-decoration: none;">Perry4LawOrganisation (P4LO)</span></a> believe that a new and proper <a href="http://cybersecurityofindia.blogspot.in/2015/03/cyber-security-policy-of-india-2015.html" target="_blank"><span style="text-decoration: none;">cyber security policy of India 2015</span></a> must be urgently formulated
by Narendra Modi government.

With fast urbanisation
and stress upon establishment of smart cities, which mainly depends
on information and communication technologies (ICT) to provide public
services, we can expect increased number of cyber attacks upon
critical infrastructure of India. The <a href="http://ptlb.in/csrdci/wp-content/uploads/2014/01/Critical-Infrastructure-Protection-In-India-The-Problems-Challenges-And-Solutions.pdf" target="_blank"><span style="text-decoration: none;">critical infrastructure protection in India </span></a>(PDF) has its own
challenges and issues. Similarly, <a href="http://cybersecurityofindia.blogspot.in/2015/11/smart-cities-cyber-security-in-india_16.html" target="_blank"><span style="text-decoration: none;">smart cities cyber security in India</span></a> would have their own
<a href="http://cybersecurityforindia.blogspot.in/2015/11/smart-cities-cyber-security-in-india.html" target="_blank"><span style="text-decoration: none;">problems and solutions</span></a>. There is no second opinion that cyber
attacks are going to increase further and this would raise
complicated <a href="http://perry4law.co.in/cyber_security/" target="_blank"><span style="text-decoration: none;">international legal issues of cyber attacks and cyber security.</span></a>

For instance it was
reported in 2014 that there was a 136% increase in cyber threats and
attacks against Indian government organisations as compared to the
previous year. Similarly, there was 126% increase in attacks
targeting financial services organisations. There is no doubt that a
strong cyber security infrastructure is need of the hour in India.
Even the national cyber security policy of 2013 must be substituted
with the new cyber security policy of India 2015.</div>

Perry4Law Organisation
(P4LO) has been suggesting formulation of the <a href="http://www.ptlb.in/iips/wp-content/uploads/2014/02/Encryption-Policy-Of-India-Needed.pdf" target="_blank"><span style="text-decoration: none;">encryption policy of India</span></a> (PDF) for long. As a result Indian
government tried to bring an encryption policy recently under Section
84A of the Information Technology Act, 2000 (IT Act 2000) but it was
highly defective. The government ultimately scrapped the encryption
policy but it need to be formulated in a proper manner again.

the following cyber security challenges in India:

(1) Cyber security is not
a very easy process to manage. It requires both <a href="http://ptlb.in/csrdci/?p=340" target="_blank"><span style="text-decoration: none;">technological expertise and legal compliances</span></a> which are lacking in the
country.</div>

(2) There are no
dedicated <a href="http://perry4law.org/cecsrdi/?p=1095" target="_blank"><span style="text-decoration: none;">cyber security laws in India</span></a>, except one or two sections in the
the IT Act 2000 which also has its <a href="http://perry4law.org/cecsrdi/?p=1068" target="_blank"><span style="text-decoration: none;">shortcomings</span></a>
such as <a href="http://perry4law.org/cecsrdi/?p=1017" target="_blank"><span style="text-decoration: none;">lack of privacy</span></a>, lack of <a href="http://ptlb.in/clpic/" target="_blank"><span style="text-decoration: none;">civil liberties protection</span></a>, absence of <a href="http://perry4law.org/cecsrdi/?p=1139" target="_blank"><span style="text-decoration: none;">cyber security breaches disclosure norms</span></a> etc.</div>

(3) The IT Act 2000 was
passed to govern legal issues of e-commerce, e-governance, cyber
crimes, etc. But, according to experts, new and better techno-legal
laws must be enacted in place of the old law. Techno legal experts
believe that Indian laws like <u><a href="http://perry4law.org/cyberlawsinindia/?p=11" target="_blank">IT Act 2000</a> </u>and <a href="http://ptlb.in/iips/?p=415" target="_blank">telegraph act</a> require urgent repeal and new and better techno legal laws
must be enacted to replaces these laws.</div>

(4) On 13 April 2015, the
government announced that the Ministry of Home Affairs would form a
committee of officials from the Central Bureau of Investigation,
Intelligence Bureau, Delhi Police, National Investigation Agency and
ministry itself to produce a new legal framework similar to the
erstwhile Section 66A of IT Act 2000. However, it is still to be
enacted as per the information available with Perry4Law Organisation
(P4LO).

must be properly understood and effectively implemented in India. </span>

India is presently facing
many type of cyber security threats. These include sophisticated
cyber attacks, cracking, <a href="http://tljin.blogspot.in/2013/11/indian-government-must-seriously-and.html" target="_blank"><span style="text-decoration: none;">child pornography</span></a>, cyber stalking, denial of service (DoS)
attacks, distributed denial of service (DDoS) attack, malware
infections, zero day vulnerabilities, phishing attacks, data theft,
etc. In June 2012, cyber attacks were reported on the Indian Navy’s
Eastern Command systems. On July 12, 2013, just few days after the
release of the National Cyber Security Policy, several high-level GOI
officials reported their emails had been hacked. A report later on
revealed that almost 12,000 systems were hacked which included
systems from the Ministry of External Affairs, Defence Research and
Development Organisation, Ministry of Home Affairs, National
Informatics Centre etc. There are also few reports of Pakistan
indulging in threatening cyber warfare. Hacker groups based out of
Karachi and Lahore have in recent years managed to hack the websites
of the Central Bureau of Investigation (CBI) and the Bharat Sanchar
Nigam Limited (BSNL) mostly to leave hate mail. It is widely believed
that regional terrorist outfits, like the Indian Mujahideen (IM) have
also made use of social media sites to communicate effectively.</div>

considering the ever-increasing <a href="http://cjnewsind.blogspot.in/2015/11/smart-cities-cyber-security-in-india.html" target="_blank"><span style="text-decoration: none;">cyber security challenges</span></a> in India.</div>

(2) It is high time that

Without a proper homework and due diligence, a project may face many
shortcomings, lacuna and limitations. One such project is known as

India</a><span style="text-decoration: none;">. As on date, the
Digital India project of India government is heading towards </span><a href="http://perry4law.co.in/news/?p=24" target="_blank">rough
waters</a><span style="text-decoration: none;"> and problems. This is
because Digital India project is suffering from many </span>shortcomings
and limitations<span style="text-decoration: none;"> that Indian
government has failed to remove. </span>

is not in a good shape. Take the example of </span><a href="http://cybersecurityofindia.blogspot.in/2015/11/smart-grids-cyber-security-in-india.html" target="_blank">smart
grids cyber security in India</a><span style="text-decoration: none;">.
India is contemplating using of </span><a href="http://ictps.blogspot.in/2012/04/smart-meters-becoming-headache-for.html" target="_blank">smart
meters</a><span style="text-decoration: none;"> but the same has
become a </span><a href="http://ptlb.in/iips/?p=30" target="_blank">headache</a><span style="text-decoration: none;">
for the power companies. Even a </span><a href="http://cybersecurityofindia.blogspot.in/2015/11/grid-security-expert-system-gses-of.html" target="_blank">Grid
Security Expert System (GSES) of India</a> was suggested by Indian
government in the past but the same has not been implemented till
now.

India Project of India Government is the classic example of use of
Information and Communication Technology (ICT) for delivery of public
services. Like any great project, Digital India is also suffering

The chief among them are lack of </span><a href="http://cybersecurityofindia.blogspot.in/2015/11/indian-cyberspace-must-be-protected-on.html" target="_blank">Cyber
Security</a><span style="text-decoration: none;">, ineffective </span><a href="http://ptlb.in/clpic/" target="_blank">Civil
Liberties Protection</a><span style="text-decoration: none;">, absence
of </span><a href="http://ptlb.in/clpic/wp-content/uploads/2014/01/Data-Protection-Laws-In-India-And-Privacy-Rights-In-India.pdf" target="_blank">Data
Protection</a><span style="text-decoration: none;"> (PDF) and </span><a href="http://www.electroniccourts.in/privacylawsindia/" target="_blank">Privacy
Protection</a><span style="text-decoration: none;">, </span><a href="http://ptlb.in/clpic/?p=363" target="_blank">unregulated
E-Surveillance</a><span style="text-decoration: none;"> in India,

the initial objective of public delivery of services through use of
ICT seems to be fading away day by day. Instead of public services
the focus has now been shifted towards e-surveillance and data
mining. To make this work, Indian Government has been using
e-surveillance projects like </span><a href="http://www.electroniccourts.in/privacylawsindia/?p=122" target="_blank">Aadhaar</a><span style="text-decoration: none;">,
</span><a href="http://ptlb.in/clpic/?p=103" target="_blank">Central
Monitoring System</a><span style="text-decoration: none;">, </span><a href="http://ptlb.in/clpic/?p=261" target="_blank">Network
and Traffic Analysis System (NETRA)</a><span style="text-decoration: none;">,
</span><a href="http://www.electroniccourts.in/privacylawsindia/?p=127" target="_blank">National
Intelligence Grid (NATGRID)</a><span style="text-decoration: none;">,
</span><a href="http://ptlb.in/csrdci/?p=259" target="_blank">National
Cyber Coordination Centre (NCCC)</a><span style="text-decoration: none;">,
etc. None of them is supported by any “Legal Framework” and
“Parliamentary Oversight”.</span></div>

<span style="text-decoration: none;">In fact,
Vodafone has confirmed that India has been using “</span><a href="http://perry4law.co.in/blog/?p=71" target="_blank">Secret
Wires</a><span style="text-decoration: none;">” in the Telecom
Infrastructure to indulge in e-surveillance. Indian Department of
Telecommunications suppressed the whole incidence with a mere
assurance of “</span><a href="http://perry4law.co.in/blog/?p=76" target="_blank">Investigation</a><span style="text-decoration: none;">”
that never took place. As per my personal information, no “Public
Report” was made available in this regard by Indian Government so
far.</span></div>

<span style="text-decoration: none;">In a latest
twist, the Indian Government clubbed its latest Project named Digital
Locker with Aadhaar. Essentially it means that Digital Locker is a
legal project </span><a href="http://cjnewsind.blogspot.in/2015/02/digital-locker-is-legal-project-based.html" target="_blank">based
upon illegal technology</a><span style="text-decoration: none;"> named
Aadhaar. I have serious doubts that Digital Locker would serve its or
</span><a href="http://ptlb.in/iips/?p=554" target="_blank">Digital
India’s purpose</a><span style="text-decoration: none;"> in these
circumstances. The matter does not end here. Indian Government has
claimed before the Supreme Court that </span><a href="http://ptlbindia.blogspot.in/2015/11/aadhaar-not-compulsory-for-government.html" target="_blank">Aadhaar
is not mandatory</a><span style="text-decoration: none;"> for availing
public services. However, this stand of Indian Government is not
correct as Aadhaar has already been made compulsory for many public
services and many more are added on regular basis.</span></div>

Surprisingly, Supreme
Court has not invoked either the Contempt or the Perjury proceedings
against Central Government and States for making false claims and
giving incorrect statements. Is not it the duty of Supreme Court to
protect the Fundamental and Human Rights of Indian Citizens and
residents? It is difficult to believe that Supreme Court is not aware
of the ground situation that is actually happening in India. How can
the Supreme Court simply rely upon false and misleading statements
and allow the Central Government and States to operate in a manner
that is clearly prejudicial to the Constitutional Protections and
Principles?</div>

Government where every bit of “Digital Information” can be

It is not difficult to visualise a scenario of cyber
attacks against the critical infrastructures of the smart cities that
are run by ICT and technology. Such a cyber attack can cripple the
entire smart city if properly executed. <a href="http://ptlb.in/csrdci/wp-content/uploads/2014/01/Critical-Infrastructure-Protection-In-India-The-Problems-Challenges-And-Solutions.pdf" target="_blank">Critical
infrastructure protection in India</a> (PDF) is still at nascent
stage. The national cyber security policy of India 2013 is also <a href="http://perry4law.org/cecsrdi/?p=1011" target="_blank">very
weak</a> and even that has <a href="http://perry4law.org/cecsrdi/?p=1128" target="_blank">not
been implemented</a> by Indian government so far. The much awaited
<a href="http://cybersecurityofindia.blogspot.in/2015/03/cyber-security-policy-of-india-2015.html" target="_blank">cyber
security policy of India 2015</a> is also missing so far.</div>

A strong cyber security infrastructure of India is
need of the hour especially when there is no well settled
<a href="http://perry4law.co.in/cyber_security/" target="_blank">international
legal issues of cyber attacks</a> that can be invoked in the case of
a cyber incidence. It is very important that international legal
issues of cyber attacks must be <a href="http://perry4law.co.in/cyber_security/?p=70" target="_blank">resolved</a>
by various government and non government stakeholders. There is no
globally acceptable <a href="http://perry4law.org/blog/?p=53" target="_blank">cyber
law treaty</a> and <a href="http://ptlb.in/csrdci/wp-content/uploads/2014/01/International-Cyber-Security-Treaty-Is-Required.pdf" target="_blank">cyber
security treaty</a> (PDF) that can govern the relationships between
various countries. Even the <a href="http://perry4law.org/cecsrdi/wp-content/uploads/2014/11/The-Tallinn-Manual-On-The-International-Law-Applicable-To-Cyber-Warfare.pdf" target="_blank">Tallinn
Manual on the International Law Applicable to Cyber Warfare</a>
(PDF) is just an academic document with no legal binding obligations.
The truth is that Tallinn Manual is <a href="http://perry4law.org/cecsrdi/?p=453" target="_blank">not
applicable</a> to international cyber warfare attacks and defence and
countries are free to take measures as per their own choices.</div>

This has necessitated that cyber security related
projects in India must be not only expedited but they must also be
successfully implemented as soon as possible. Unfortunately, cyber

Security Expert System (GSES) of India</a>, <a href="http://perry4law.co.in/cyber_security/?p=34" target="_blank">National
Counter Terrorism Centre (NCTC) of India</a>, <a href="http://ptlb.in/csrdci/?p=254" target="_blank">Cyber
Attacks Crisis Management Plan of India</a>, <a href="http://perry4law.org/blog/?p=203" target="_blank">Crisis

(CECSRDI)</a> believe that Modi government must take cyber security
seriously. The <a href="http://ptlb.in/csrdci/?p=340" target="_blank">cyber
security challenges in India</a> would increase further and India
must be <a href="http://perry4law.co.in/cyber_security/?p=25" target="_blank">cyber
prepared</a> to protect its cyberspace. CECSRDI believes that the
starting point is to draft the cyber security policy of India 2015 as
the 2013 policy is highly defective and of little significance. We
also believe that a dedicated <a href="http://perry4law.org/cecsrdi/?p=1095" target="_blank">cyber
security law of India</a> is need of the hour. The same must be a
<a href="http://perry4law.org/clic/?p=66" target="_blank">techno
legal framework</a> keeping in mind contemporary cyber security
threats. Further <a href="http://perry4law.org/cecsrdi/?p=1139" target="_blank">cyber
security disclosure norms in India</a> must be formulated by Modi

security awareness in India</a> must be further improved so that

Organisation (P4LO)</span></a> it has been revealed that the Aarushi
murder case reflects <a href="http://perry4law.org/?p=70" target="_blank"><span style="text-decoration: none;">poor
cyber forensics usage</span></a> by CBI and defense lawyers. The way
investigation and prosecution was conducted in the Aarushi case, it
is clear that electronic evidences were not given the importance that
they deserved. It was very much possible to ascertain the truth with
great certainty if electronic evidences were forensically acquired by
CBI and the defense lawyers used the same while examination and cross
examination of the prosecution witnesses.

before the Supreme Court of India. In another related case, the
Supreme Court of India has held that the Aadhaar <a href="http://ptlb.in/clpic/?p=228" target="_blank"><span style="text-decoration: none;">cannot
be made compulsory</span></a> for availing Public Services.
Similarly, the Supreme Court has also <a href="http://www.electroniccourts.in/privacylawsindia/?p=59" target="_blank"><span style="text-decoration: none;">restrained
UIDAI</span></a> from transferring any Biometric Information of any
person who has been allotted the Aadhaar number to any other Agency

Aadhaar Project in its “Current Form” is

comprehensive regulatory framework in this regard, online card games
and online games are still legally risky ventures.</div>

Monitoring System (CMS)</span></a>, <a href="http://ptlb.in/blog/?p=247" target="_blank"><span style="text-decoration: none;">National
Intelligence Grid (Natgrid)</span></a>, Internet Spy System Network
and Traffic Analysis System (<a href="http://ptlb.in/clpic/?p=261" target="_blank"><span style="text-decoration: none;">NETRA</span></a>),
National Cyber Coordination Centre (<a href="http://ptlb.in/csrdci/?p=259" target="_blank"><span style="text-decoration: none;">NCCC</span></a>),
etc. To make the matter worst, Indian Government has been postponing

helplessly while the Executive branch has usurped the “Legislative
Powers” and literally mocked all sorts of <a href="http://ptlb.in/clpic/?p=351" target="_blank"><span style="text-decoration: none;">Judicial

Take the example of the <a href="http://www.electroniccourts.in/privacylawsindia/wp-content/uploads/2014/07/Unique-Identification-Authority-Of-India-And-Anr.-v.-Central-Bureau-Of-Investigation-SLP-Cr-Nos.25242014.pdf" target="_blank"><span style="text-decoration: none;">interim
order</span></a> (PDF) issues by Supreme Court of India mandating
that Aadhaar cannot be made mandatory for availing various public
services. Although Central Government has informed the Supreme Court
that <a href="http://perry4law.co.in/news/?p=22" target="_blank"><span style="text-decoration: none;">Aadhaar
is not mandatory</span></a> for availing public services yet it has
been made compulsory for almost all the <a href="http://ptlb.in/iips/?p=554" target="_blank"><span style="text-decoration: none;">digital</span></a>
and non digital services in India. As a result a wonderful project
like Digital India would be heading for <a href="http://perry4law.co.in/news/?p=24" target="_blank"><span style="text-decoration: none;">rough
waters</span></a> if our Judiciary is even “Remotely Sensitive”
to Civil Liberties Violation issues.</div>

This is also not the end of the story. When
everything is clubbed with Aadhaar, it gives a complete control to
our E-Surveillance loving Government over our digital and non digital
lives. There is nothing left to claim <a href="http://www.electroniccourts.in/privacylawsindia/?p=134" target="_blank"><span style="text-decoration: none;">Informational
Privacy</span></a> from our own Government. Privacy is our <a href="http://www.electroniccourts.in/privacylawsindia/?p=113" target="_blank"><span style="text-decoration: none;">Human
Right</span></a> and not a Government charity and it should not be
taken away with direct or indirect methods.</div>

What is most anguishing is the “<a href="http://ptlb.in/clpic/?p=394" target="_blank"><span style="text-decoration: none;">Deafening
Silence</span></a>” of the Parliament of India and Indian Supreme
Court to resolve these issues. Why Parliament has abdicated its
“Legislative Powers” in favour of the Executive and why Supreme
Court has not taken the Executive stringently cannot be explained
with any rationale explanation. However, in the absence of exercise
of their “Constitutional Duties” we can safely conclude the
“Separation of Powers” under the Indian Constitution has “ceased
to exist” in the present and turbulent E-Surveillance era of India.</div>

that pertains to Internet Intermediary liability and observance of

law due diligence</span></a> (PDF) by them. In fact, it has been
claimed that Supreme Court has <a href="http://perry4law.co.in/news/?p=106" target="_blank"><span style="text-decoration: none;">killed</span></a>
cyber law due diligence in India to a great extent. </div>

has been covering these issues from the very beginning. Now CCICI has
taken this interpretation and effort to another level by starting an

Unfortunately, most of the interpretations and
observations regarding the judgment of Supreme Court were directed
towards Section 66A alone and the issue of cyber law due diligence
was totally ignored. This has serious ramifications for all cyber
victims whose locus standi has been taken away by the Supreme Court
to approach the Intermediary.</div>

It is of utmost importance that this issue must be
discussed in great detail and then taken up before the Supreme Court
through a review petition. Similarly, the collective inputs can also
be shared with Indian government and Parliament so that they can come

Cyber law jurisprudence is still evolving in India
despite the fact that Indian cyber law was enacted almost 15 years
back. This is so because Indian Legislature and Executive are not at
all comfortable to deal with technology related laws. Techno legal
experts have been maintaining that India must establish a <a href="http://perry4law.org/clic/?p=66" target="_blank"><span style="text-decoration: none;">techno
legal framework</span></a> to deal with growing cases of cyber crimes
and cyber attacks. Nevertheless the position has remained the same
and India is still lagging far behind in formulating technology
related laws. </div>

Not only Indian Parliament is not capable of
enacting good and effective techno legal laws but it is also very
keen in abdicating its duties to Executive. As a result successive
Indian governments have used subordinate/delegated legislations to
impose draconian and civil liberties violating laws upon Indians.
Obviously, the Supreme Court of India is not pleased to either
such draconian laws or to the approach adopted by Indian Executive
and Parliament.

Recently Supreme Court held that <a href="http://perry4law.co.in/news/?p=103" target="_blank"><span style="text-decoration: none;">Aadhaar
is not compulsory</span></a> to avail government services in India.
Now Supreme Court has struck down Section 66A of Information
Technology Act, 2000 (IT Act 2000) as unconstitutional. The case of

of these provisions was challenged, Supreme Court had limited

keep them operational and constitutional. But it has not been
realised at what cost this has been done.</div>

Supreme Court’s Judgment on Section 66A is a <a href="http://ptlb.in/ccici/?p=472" target="_blank"><span style="text-decoration: none;">big
blow</span></a> for Cyber Law Due Diligence in India and reading down
of Section 79(3) (b) and Rule 3(4) by Supreme Court in the present
manner is “<a href="http://ptlb.in/ccici/?p=481" target="_blank"><span style="text-decoration: none;">Counter
Productive</span></a>” in long run. He has also suggested that Modi

In a surprising disclosure, it has been revealed
that Twitter is censoring digital India related <a href="http://www.electroniccourts.in/privacylawsindia/?p=146" target="_blank"><span style="text-decoration: none;">dissenting
tweets</span></a> in India. Previously it was revealed that Twitter
was censoring tweets pertaining to <a href="http://perry4law.co.in/news/?p=43" target="_blank"><span style="text-decoration: none;">Aadhaar</span></a>
in similar fashion. In fact, aadhaar is a <a href="http://ptlb.in/clpic/?p=383" target="_blank"><span style="text-decoration: none;">heavily
censored subject</span></a> in India for long.

Speech and expression in general and <a href="http://ptlb.in/clpic/" target="_blank"><span style="text-decoration: none;">civil
liberties in cyberspace</span></a> in particular are under severe
attack from none other than our own government. <a href="https://www.linkedin.com/pub/praveen-dalal/3a/613/5ba" target="_blank"><span style="text-decoration: none;">Praveen
Dalal</span></a>, whose <a href="https://twitter.com/praveen_dalal" target="_blank"><span style="text-decoration: none;">tweets</span></a>
on Digital India are censored on a regular basis, believes that far
from digital empowerment, Digital India has become the <a href="http://www.electroniccourts.in/privacylawsindia/?p=139" target="_blank"><span style="text-decoration: none;">Biggest
Panopticon of Human Race</span></a>. Any tweet about this “<a href="http://ptlb.in/clpic/?p=394" target="_blank"><span style="text-decoration: none;">Digital
Panopticon of India</span></a>” is also censored by Twitter almost
in “Real Time”.

It is not the purpose of Twitter to be a “Media
Agent” of Indian Government and censor tweets that are criticising
the Digital India project for its Weaknesses, Illegalities and
Unconstitutionalities, suggests Dalal.

All this is happening because Indian Parliament and
Supreme Court have failed to curb the growing constitutional

Supreme Court has also failed to declare <a href="http://ptlb.in/clpic/?p=351" target="_blank"><span style="text-decoration: none;">Aadhaar
as unconstitutional</span></a> and this is the root cause of all
troubles in India.

so far. Let us hope that good sense would prevail and Indian
government would stop abusing civil liberties of Indians.

of the digital locker facility. This may be an attempt on the part of
the Government to show its progress especially in the direction of
fulfilling Digital India dream. However, not everything is smooth and
legal in the digital locker project.

On a closer analysis, it becomes apparent that
digital locker relies upon illegal and unconstitutional technology
popularly known as Aadhaar. Till the time of writing of this article,
Aadhaar project is not supported by any legal framework and is
clearly violating the civil liberties and fundamental rights of
Indian masses.

project in its present form has no welfare element but is purely an

cloud computing adoption in India, mobile security and mobile
governance issues, critical infrastructure protection requirements in
India, etc.

dedicated cyber security law in India as on date. In the past Indian

will resulted in lapse of that idea.

of Things (IoT)</span></a> (PDF) that also without any <a href="http://ptlb.in/csrdci/?p=254" target="_blank"><span style="text-decoration: none;">cyber
crisis management plan of India</span></a> and establishment of
<a href="http://ptlb.in/csrdci/?p=57" target="_blank"><span style="text-decoration: none;">offensive
and defensive cyber security capabilities</span></a>.

It is also expected that malware like Stuxnet, Duqu,
Flame, etc would be used more aggressively in the year 2015. These
malware are not only stealth but they are also too sophisticated to

2014 witnessed a combination of progressive and regressive steps
being taken by Indian Government.

On the progressive side the Telecom Commission of
India has allowed <a href="http://perry4law.co.in/blog/?p=79" target="_blank"><span style="text-decoration: none;">satellite
based mobile services in India</span></a> in the year 2014. On the
regressive side, the Indian Government has failed to protect <a href="http://ptlb.in/clpic/" target="_blank"><span style="text-decoration: none;">civil
liberties in cyberspace</span></a> once again. In fact, telecom
operator Vodafone revealed use of <a href="http://perry4law.co.in/blog/?p=71" target="_blank"><span style="text-decoration: none;">secret
wires</span></a> for government e-surveillance and eavesdropping
worldwide, including in India.

Indian Department of Telecommunications (DoT)
promised to <a href="http://perry4law.co.in/blog/?p=76" target="_blank"><span style="text-decoration: none;">investigate</span></a>
govt snooping allegations of Vodafone but it failed to do so till the
end of December 2014. The dangerous <a href="http://ptlb.in/csrdci/?p=12" target="_blank"><span style="text-decoration: none;">central
monitoring system (CMS) of India</span></a> was also <a href="http://ptlb.in/clpic/?p=109" target="_blank"><span style="text-decoration: none;">activated</span></a>
without any legal framework and Parliamentary oversight.</div>

Similarly, the redundant and outdated telecom
related laws remained on the statue book in the year2014. For
instance, the <a href="http://ptlb.in/iips/?p=415" target="_blank"><span style="text-decoration: none;">telegraph</span></a>
and <a href="http://perry4law.org/cyberlawsinindia/?p=11" target="_blank"><span style="text-decoration: none;">cyber
law of India</span></a> remained outdated, colonial and draconian in
the year 2014. Similarly, <a href="http://perry4law.co.in/blog/?p=67" target="_blank"><span style="text-decoration: none;">encryption
related</span></a> dedicated laws in India are also missing till the
end of December 2014.</div>

Further, new lawmaking was also missing in the year
2014. For instance, there is no dedicated <a href="http://ptlb.in/iips/?p=45" target="_blank"><span style="text-decoration: none;">laws
regarding cell phones</span></a> and their dealings in India and the
same continued till the end of December 2014 as well. In particular,
the <a href="http://ptlb.in/iips/?p=164" target="_blank"><span style="text-decoration: none;">cell
site data location laws in India and privacy issues</span></a> are
still not redressed by Indian Government so far.</div>

India is also one of the countries where phone
tapping is possible without any court order/warrant. This is a
serious civil liberty violation that continued in the year 2014. A
<a href="http://perry4law.org/cecsrdi/?p=930" target="_blank"><span style="text-decoration: none;">lawful
and constitutional interception law in India</span></a> is urgently
needed. <a href="http://ptlb.in/csrdci/wp-content/uploads/2014/01/Privacy-Rights-In-India-In-The-Information-Age.pdf" target="_blank"><span style="text-decoration: none;">Privacy

India has been experimenting with technology for
long. Even a basic level legal framework has been introduced in India
in the form of Information Technology Act, 2000 though it requires
immediate <a href="http://ptlb.in/iips/?p=415" target="_blank"><span style="text-decoration: none;">repeal
or amendment</span></a>. There are many shortcomings of the IT Act
2000 and one of them is <a href="https://www.linkedin.com/today/post/article/20140609044832-181854285-why-e-governance-has-failed-in-india-and-how-to-make-it-successful-praveen-dalal" target="_blank"><span style="text-decoration: none;">non
binding nature</span></a> of <a href="https://en.wikipedia.org/wiki/E-Governance" target="_blank"><span style="text-decoration: none;">e-governance</span></a>
obligations of Indian government. The <a href="https://en.wikipedia.org/wiki/National_e-Governance_Plan" target="_blank"><span style="text-decoration: none;">National
E-Governance Plan (NEGP)</span></a> of India has also failed to meet
its objectives and marks. As a result India has failed on the fronts
of both <a href="https://en.wikipedia.org/wiki/E-Government" target="_blank"><span style="text-decoration: none;">e-government</span></a>
and e-governance.</div>

While India is still struggling to deal with basic
level technology adoption, the BJP government has announced projects
like <a href="https://en.wikipedia.org/wiki/Digital_India" target="_blank"><span style="text-decoration: none;">Digital
India</span></a> and Internet of things (IoT) that rely prominently
upon technology. These projects intend to extend the services to
general public in the filed like healthcare, education, judicial
services etc.

As far as judiciary is concerned, we are still
struggling to establish the <a href="http://legalenablementofictinindia.blogspot.in/2009/11/e-courts-in-india-essential-judicial.html" target="_blank"><span style="text-decoration: none;">first
e-court of India</span></a> till October 2014. In these
circumstances, achieving the objective of establishing e-judiciary in
India is still a <a href="http://egovreach.in/social/content/e-courts-india-still-distant-dream" target="_blank"><span style="text-decoration: none;">distant
dream</span></a>. E-judiciary project of India is also suffering from
lack of techno legal expertise to manage the same. For instance, we
have a single techno legal <a href="http://www.electroniccourts.in/" target="_blank"><span style="text-decoration: none;">e-courts
training centre in India</span></a>. There is urgent need to develop
<a href="http://ptlb.in/tlsdi/?p=62" target="_blank"><span style="text-decoration: none;">e-courts
skills in India</span></a> so that e-judiciary project can become a
reality.

However, it is not the case that no progress has
been made in this regard. India judiciary has taken a pro active role
to introduce technology for legal and judicial purposes. For instance
<a href="http://ptlb.in/iips/?p=299" target="_blank"><span style="text-decoration: none;">legal
notices can be served through e-mails</span></a>, <a href="http://www.electroniccourts.in/blog/?p=737" target="_blank"><span style="text-decoration: none;">e-filing
directions</span></a> has been prescribed by Delhi High Court,
<a href="http://www.electroniccourts.in/blog/?p=747" target="_blank"><span style="text-decoration: none;">marriage
registration certificates</span></a> can be obtained through video
conferencing, etc.</div>

If India wishes to achieve her noble objective of
providing <a href="http://www.electroniccourts.in/blog/?p=761" target="_blank"><span style="text-decoration: none;">access
to justice to marginalised segment of India</span></a>, <a href="http://perry4law.org/blog/?p=520" target="_blank"><span style="text-decoration: none;">courts
automation</span></a> and <a href="http://perry4law.org/blog/?p=965" target="_blank"><span style="text-decoration: none;">digital
preservation</span></a>, much more is required to be done. Mere
policy formulation is not going to be helpful and it is the actual
implementation that is important. The BJP government must stress upon
actual implementation than formulating policies and strategies that
remain on paper alone.

Aadhaar initiative was introduced as an optional and
enabling technology. With the passage of time, Indian government has
made Aadhaar not only compulsory but also an intrusive, privacy
violating and <a href="https://en.wikipedia.org/wiki/Mass_surveillance_in_India" target="_blank"><span style="text-decoration: none;">mass
surveillance</span></a> instrument. Surprisingly, none of the
<a href="http://ptlb.in/clpic/?p=363" target="_blank"><span style="text-decoration: none;">e-surveillance
projects of India</span></a> have any sort of parliamentary
oversight. Aadhaar is also suffering from various vices and
constitutional infirmities. This was the reason that the Supreme
Court of India <a href="http://ptlb.in/clpic/?p=228" target="_blank"><span style="text-decoration: none;">declared</span></a>
that Aadhaar <a href="http://www.electroniccourts.in/privacylawsindia/wp-content/uploads/2014/07/Unique-Identification-Authority-Of-India-And-Anr.-v.-Central-Bureau-Of-Investigation-SLP-Cr-Nos.25242014.pdf" target="_blank"><span style="text-decoration: none;">cannot
be made mandatory</span></a> (Pdf) for availing services in India.</div>

Aadhaar is also suffering from many other
infirmities. For instance, there is no <a href="http://www.electroniccourts.in/privacylawsindia/" target="_blank"><span style="text-decoration: none;">privacy
law in India</span></a> and <a href="http://ptlb.in/clpic/wp-content/uploads/2014/01/Data-Protection-Laws-In-India-And-Privacy-Rights-In-India.pdf" target="_blank"><span style="text-decoration: none;">data
protection law in India</span></a> (pdf) as on date. Aadhaar has also
failed to address the concerns of <a href="http://perry4law.org/cecsrdi/?p=615" target="_blank"><span style="text-decoration: none;">data
security</span></a>, <a href="http://ptlb.in/csrdci/wp-content/uploads/2013/12/Cyber-Security-Trends-And-Developments-In-India-2013.pdf" target="_blank"><span style="text-decoration: none;">cyber
security</span></a> (PDF) and <a href="http://ptlb.in/clpic/" target="_blank"><span style="text-decoration: none;">civil
liberties</span></a> in India. The intelligence agencies of India are
operating without any <a href="http://ptlb.in/clpic/?p=324" target="_blank"><span style="text-decoration: none;">parliamentary
oversight</span></a> and they need <a href="http://perry4law.co.in/cyber_security/?p=55" target="_blank"><span style="text-decoration: none;">urgent
reforms</span></a> in these circumstances.

It is not the case that Indian government is not
aware of these issues and circumstances. However, Indian government
prefers to keep the things in a state of anarchy and chaos by citing
national security and welfare schemes. The truth is that both the
concepts of <a href="http://www.electroniccourts.in/privacylawsindia/?p=110" target="_blank"><span style="text-decoration: none;">national
security</span></a> and <a href="http://www.electroniccourts.in/privacylawsindia/?p=122" target="_blank"><span style="text-decoration: none;">welfare
schemes</span></a> are baseless in India when it comes to blatant
violation of civil liberties of Indians.
</div>

<div align="JUSTIFY">
The only solace is the fact that these issues are
presently <a href="http://perry4law.org/cecsrdi/?p=609" target="_blank"><span style="text-decoration: none;">pending</span></a>
before the Indian Supreme Court to be adjudicated upon. The Supreme
Court has already issues interim orders prohibiting the state
governments and central government from discriminating on the ground
of non availability of Aadhaar number. However, till now these
directions have been openly violated by Indian government and various
state governments.

This is also a hint of confrontation between the
executive and judiciary that is solely provoked by the executive in
an illegal and unconstitutional manner. There is little hope that the
<a href="http://ptlb.in/clpic/?p=346" target="_blank"><span style="text-decoration: none;">proposed
law</span></a> in this regard may be enacted very soon, if at all.
The only option left in these circumstances is that the Supreme Court
of India <a href="http://ptlb.in/clpic/?p=351" target="_blank"><span style="text-decoration: none;">must
declare</span></a> Aadhaar project illegal and unconstitutional and
<a href="http://ptlb.in/clpic/?p=341" target="_blank"><span style="text-decoration: none;">scrap</span></a>
the same in the larger interest of India.

in India</span></a> is a complicated legal field as Indian
Constitution has conferred the power to make laws regarding gambling
to various states of India. While these states are free to make
gambling and gaming laws within the parameters of their respective
jurisdictions, they cannot encroach upon the territories of other
states in this regard.

When Internet and other technologies are used,
gambling and gamming assumes the character of online gambling and
gaming. This is clearly not allowed as per the constitutional scheme.
This is the reason that <a href="https://en.wikipedia.org/wiki/Online_Gambling_In_India" target="_blank"><span style="text-decoration: none;">online
gambling in India</span></a> is a subject for the central government
to manage. However, <a href="http://perry4law.org/onlinegamingandgambling/?p=175" target="_blank"><span style="text-decoration: none;">online
gambling legal issues in India</span></a> are not easy to manage.

The issue of legality of online gaming in India is
<a href="http://perry4law.org/onlinegamingandgambling/?p=146" target="_blank"><span style="text-decoration: none;">pending</span></a>
before the Supreme Court of India says Praveen Dalal, managing
partner of New Delhi based technology law firm <a href="http://perry4law.com/index.html" target="_blank"><span style="text-decoration: none;">Perry4Law</span></a>.
However, the decision of Supreme Court in this regard may not bring a
relief to online gaming stakeholders <a href="http://perry4law.org/onlinegamingandgambling/?p=150" target="_blank"><span style="text-decoration: none;">at
large</span></a>. The Supreme Court <a href="http://perry4law.org/onlinegamingandgambling/?p=161" target="_blank"><span style="text-decoration: none;">sought</span></a>
the opinion of Central Government in this regard but the same was <a href="http://perry4law.org/onlinegamingandgambling/?p=167" target="_blank"><span style="text-decoration: none;">not
formally provided</span></a> by the Central Government till now.

The problem with online poker and online rummy

following the laws of India and are actually violating the same,
informs Dalal. They may be prosecuted very soon as allowing them to

prosecutions of various individuals and companies in India in this
regard. For instance, recently the owner of an online betting website

in Mumbai for allowing betting on his website. Similar arrests have

<a href="http://perry4law.org/onlinegamingandgambling/?p=132" target="_blank"><span style="text-decoration: none;">Ahmedabad</span></a>,
<a href="http://ptlb.in/ccici/?p=394" target="_blank"><span style="text-decoration: none;">Mumbai</span></a>,
etc. The Central Bureau of Investigation (CBI) has also established a
<a href="http://perry4law.org/onlinegamingandgambling/?p=122" target="_blank"><span style="text-decoration: none;">Sports
Integrity Unit</span></a> to investigate illegal sports betting in
India.</div>

According to Perry4Law, till the time Indian Supreme
Court or central government clarifies the legal position regarding
online gaming and gambling in India, the online gaming/gambling
stakeholders must comply with existing and applicable techno legal
requirements of Indian laws.</div>

with this development as they see a ray of hope in this legal
development. They believe that this case may finally help in

regulate</span></a> Indian e-commerce. Indian government has already
started working in this direction and <a href="http://ptlb.in/ecommerce/?p=162" target="_blank"><span style="text-decoration: none;">e-commerce
business structuring in India</span></a> may be regulated
accordingly. India has also <a href="http://ptlb.in/ecommerce/?p=342" target="_blank"><span style="text-decoration: none;">declared</span></a>
that foreign companies and e-commerce portals would be required to
register in India and would be required to comply with Indian laws.

There are some areas where e-commerce websites of
India are in direct conflict with Indian laws. These include non

law due diligence</span></a> (PDF), <a href="http://ptlb.in/ecommerce/?p=238" target="_blank"><span style="text-decoration: none;">e-commerce
due diligence</span></a> and foreign exchange management act (FEMA)
compliances. Even Indian government is well aware of these
irregularities and illegalities and it waited for long to initiate
any action against the guilty e-commerce websites. Now enforcement
directorate has started investigation against many e-commerce
websites and their owners for possible violation of provisions of
FEMA.

According to <a href="http://in.linkedin.com/pub/praveen-dalal/3a/613/5ba" target="_blank"><span style="text-decoration: none;">Praveen
Dalal</span></a>, managing partner of Perry4Law, the legal position
is that Foreign Direct Investment (FDI) is not allowed in India for
Business to Consumer (B2C) Multi Retail E-Commerce Activities.
However, almost all E-Commerce Websites of India have accepted
Foreign Funding and utilised them for their E-Commerce Businesses in
direct violation of Indian Laws. They have tried to circumvent Indian
Laws by showing it as a funding for advertisement and other expenses
but this labelling would not change the “True Nature” of the
transaction, opines Dalal. Besides, there are other Techno Legal
Compliances that these E-Commerce Websites have failed to comply with
and these Irregularities and Illegalities would be investigated by
Indian Government very soon, informs Dalal.

be “Cyber Prepared” to deal with the same. The Cyber Security
Challenges before the Narendra Modi Government are not easy to manage

Cyberspace must be protected</span></a> on a “Priority Basis”.</div>

laws in India</span></a> and cyber security of India. Even the
Narendra Modi lead government has done nothing except summoning of

rights of Indians</span></a> and invading Indian cyberspace.

In these circumstances it would not be wrong to
declare that India is a sitting duck in the field of cyber security.
These days cyber security is an integral part of national security as

security policy of India</span></a> must also incorporate cyber
security as an essential component. Only time would tell whether Modi

It is covering many crucial areas pertaining to use of information
and communication technology (ICT) for providing healthcare related
services in India. However, like any service, e-health services in
India depend upon compliance of certain Indian laws that is missing
as on date. Similar is the case regarding <a href="http://cjnewsind.blogspot.in/2014/06/unregulated-m-health-activities-may-be.html" target="_blank"><span style="text-decoration: none;">m-health</span></a>
that is the upcoming field in this regard.

Information and communication technology (ICT) has
streamlined the way medical services and para medical services are
provided world over. E-health and telemedicine are examples of use of
ICT for medical purposes.</div>

However, when technology is used for medical
purposes, it gives rise to medico legal and techno legal issues. In
United States, the <a href="http://perry4law.org/clii/?p=100" target="_blank"><span style="text-decoration: none;">Health
Insurance Portability and Accountability Act of 1996 (HIPAA)</span></a>,
Health Information Technology for Economic and Clinical Health Act
(HITECH Act), etc are some of the laws that take care of medico legal
and techno legal issues of e-health and telemedicine.</div>

<div align="JUSTIFY">
On the contrary, we have no dedicated e-health and
telemedicine laws in India. Even essential attributes of these laws
like <a href="http://www.electroniccourts.in/privacylawsindia/" target="_blank"><span style="text-decoration: none;">privacy
protection</span></a>, <a href="http://ptlb.in/clpic/wp-content/uploads/2014/01/Data-Protection-Laws-In-India-And-Privacy-Rights-In-India.pdf" target="_blank"><span style="text-decoration: none;">data
protection</span></a> (PDF), data security, <a href="http://perry4law.co.in/cs.html" target="_blank"><span style="text-decoration: none;">cyber
security</span></a>, confidentiality maintenance, etc are not
governed by much needed dedicated laws.</div>

<div align="JUSTIFY">
However, numerous statues carry individual
provisions that may be applicable to e-health and telemedicine
activities in India. For instance, the e-governance and <a href="http://ptlb.in/ecommerce/" target="_blank"><span style="text-decoration: none;">e-commerce</span></a>
related aspects of e-health and tele medicine may be governed by the
Information Technology Act, 2000 (IT Act 2000) that is the <a href="http://perry4law.org/cyberlawsinindia/" target="_blank"><span style="text-decoration: none;">cyber
law of India</span></a>. All electronic contraventions and violations
pertaining to e-health and tele medicine can be regulated b the IT
Act 2000.</div>

Similarly, <a href="http://ptlb.in/clpic/wp-content/uploads/2014/01/Data-Protection-Laws-In-India-And-Privacy-Rights-In-India.pdf" target="_blank"><span style="text-decoration: none;">privacy
and data protection aspects</span></a> (PDF) in cyberspace pertaining
to e-health are also governed by the IT Act 20000. Further, the
Supreme Court of India has interpreted Article 21 of Indian
Constitution as conferring a right to privacy upon all persons in
India. Even in some cases the Supreme Court of India has held that
patients have a right to privacy to protect their health related
information except where non disclosure of such information is
violating fundamental rights of others and is against public interest
and public policy.</div>

Even data security and cyber security aspects have
been covered by the IT Act 2000 to some extent. The real problem is
that these provisions that protect privacy, data protection, data
security, etc are piecemeal efforts and they are not serving the
purposes as required.</div>

We need to have dedicated e-health laws and
regulations in India that are presently missing. The sooner these
e-health laws and regulations are formulated in India the better it
would be for the larger interest of medical community and patients in
India.
